Submissions open for new mine site safety regulation

NSW Resources is now accepting submissions for its proposed Mine and Petroleum Site Safety (Cost Recovery) Regulation 2025, with the consultation process closing on June 18.

It says the framework will build on the version drafted in 2019, which is due for automatic repeal in September.

“The proposed regulation supports the Mine and Petroleum Site Safety (Cost Recovery) Act 2005 (the Act), which provides for the funding of regulatory activities in relation to safety at mines and petroleum sites in NSW,” an NSW Resources spokesperson said.

“The Act establishes the Mine and Petroleum Site Safety Fund for this purpose.”

The proposed regulation

According to NSW Resources, it is proposed that the new regulation be remade on substantially the same terms as the regulation currently in force.

This would include the retention of provisions such as authorising payments from the Mine and Petroleum Site Safety Fund of amounts required to meet expenditure incurred in carrying out regulatory activities under, or administering or executing, the Explosives Act 2003; and exercising functions under or in connection with the Protection from Harmful Radiation Act 1990. 

Minor amendments are however proposed to replace the term ‘relevant period’ with ‘financial year’ in connection with reporting requirements and to align with the definition of ‘financial year’ in the Act; updating titles of legislation; and updating wording to reflect current regulatory drafting conventions.
